This agreement is made between Victor Hernandez (hereinafter called the “Artist”)
For the project (hereinafter called the “Project”) by You (hereinafter called the “Client”) to be completed ideally by the date specified.
In consideration of the mutual promises and agreements of the parties hereto, as hereinafter set forth,
it is agreed as follows:
1. The Client agrees to pay full compensation for the performance.
2. Payments will be made in the following order 1, 2, or 3 payments (with large commissions).
due once illustration has been rendered and completed in order relinquish all unwatermarked files to
client. Scheduled payments are required in order for the artist to proceed with the work. Once
payments are made illustrations will be presented to the client.
Payment to be made via PayPal to account/email victorlhdz@gmail.com The Artist will submit an
invoice, to be paid in order to relinquish rendered services.
Service of Contract:
1. The terms and conditions set forth in this Agreement shall have precedence over any attachment
incorporated herein in the event of any conflict.
2. All work is given to Client as exclusive work, and thus cannot be used in any condition outside of
the project by the Artist. Unless by permission of the client. Permission has been given for the Artist
to use painting in portfolio.
3. If the artwork is not completed on the date due the Artist will refund the expedited
fee.
4. Client can use the given artwork of the project for promotional use of the project.
5. Client can modify the images to fit the needs of the project.
8. Client shall have the exclusive right to use and to license the use of the Artist’s name, promotional
material, and services in and in connection with any merchandising and/or publishing under-takings.
9. The Artist reserves the right to modify compensation and terms for any future contracts with the
Client.
10. Any amendments to this contract will be modified in red and dated and executed by both parties.
Deadlines
The Artist agrees to complete the work on or before the client’s deadline date. Please consider edits
you may need done when setting the deadline.
However if the Client does not deliver all of the necessary references and information to
complete the project or changes are made that slow down the progress of the work then the Artist can
not guarantee that the project will be completed on the specified date and will inform the client.
The Artist reserves the right to adjust the rates of the project should the scope of the job, or amount of
work you have to do is increased significantly. The client is liable to pay extra for any additional
requirements they request.
Revisions:
Revisions are a part of any design process and the Artist will offer 3 free revisions or 1 hour of
revisions. These do not include any design choices the artist may have left out or typoed.
After three free revisions the artist will charge the Client.
Redesigns:
If the Artist and Client have created a design and the client decides that they need to change the
design an additional fee may be assessed–this is determined on a case by case basis and the client
will be informed.
Cancelation:
If at any point in time the Project is canceled after the Artist has started working refunds or
compensation are given in the following cases:
i) If the Artist has completed the project and the client wishes to cancel the artist will still
ii) If the Artist/Client relationship experiences irresolvable conflict depending on the amount of

Expedited Services:
If the Project has a need for a quick turnaround time the Artist will set aside other projects in
order to complete the clients within the desired time frame.
An additional charge will be added on based on the project and the time frame. A fee is
assessed in a case by case basis but is determined by hours needed to complete the project and the
amount of time given to complete the project.
If the Artist does not deliver the project on the specified date then a percentage of the fee will
be reimbursed.
However if the Client does not deliver all of the necessary references and information to complete the
project or changes are made that slow down the progress of the work then the Artist can not
guarantee that the project will be completed on the specified date and will inform the client. No fee will
be reimbursed in this case.
